1. Acceptance and binding effect
These Terms and Conditions, Software License Terms, and Trading Risk Disclosure (collectively, the “Terms”) govern every visit to the BOTIFY website and every purchase, download, installation, activation, renewal, and use of any BOTIFY Expert Advisor, indicator, utility, documentation, compiled file, update, or related support service (collectively, the “Software”). By accessing the website, placing an order, accepting the checkout acknowledgement, downloading a file, or using the Software, you confirm that you have read, understood, and agreed to these Terms.
If you do not agree, you must not purchase, download, install, or use the Software. If you accept on behalf of a company or other legal person, you represent that you have authority to bind that person.
2. Software provider only — no financial advice
BOTIFY is a software publisher and technical support provider. BOTIFY is not your broker, dealer, investment adviser, commodity trading adviser, portfolio manager, fiduciary, tax adviser, attorney, accountant, or financial planner. Nothing on the website, in the Software, in documentation, in customer support, or in any communication constitutes investment advice, a solicitation, a recommendation to buy or sell any instrument, personalized financial guidance, or a representation that a trade or strategy is suitable for you.
Support is limited to product access, installation, licensing, configuration mechanics, payment, and defect reporting. BOTIFY will not direct your entries, exits, position sizes, leverage, account funding, broker selection, or trading decisions. You must obtain independent advice from appropriately licensed professionals where needed.
3. Speculative trading and leverage risk
Foreign exchange, contracts for difference, metals, derivatives, and leveraged trading are highly speculative. A small market movement may produce a disproportionately large gain or loss. You may lose all funds deposited with a broker and, depending on the broker, product, and governing rules, may incur obligations beyond the amount deposited. Spreads, slippage, commissions, swaps, latency, rejected orders, gaps, liquidity changes, execution rules, margin calls, stop-out rules, and broker interventions may materially change results.
You alone decide whether to trade, which account to use, how much capital to risk, and whether automated execution is appropriate. You must understand your broker’s contract specifications and risk disclosures before enabling live trading.
4. No guarantee of profit or performance
No result is promised or guaranteed. Historical tests, strategy-tester reports, examples, screenshots, simulations, forward tests, descriptions, and third-party statements are illustrative only. Hypothetical results have inherent limitations and may not reflect liquidity, execution delay, data quality, changing spreads, commissions, financing charges, emotional intervention, or market conditions experienced in a live account.
Past performance does not predict future performance. Any statement about strategy logic, risk controls, recovery, hedging, trailing, filters, or account management describes programmed behavior and is not a promise that losses will be prevented or recovered.
5. Customer testing and supervision duties
Before live use, you must inspect all inputs, confirm symbol names and contract specifications, compile or install only as documented, and test the Software on a strategy tester and demo account for a period sufficient for you to understand its behavior. You must supervise every live account, maintain access to the terminal and broker, and be able to disable automated trading or close positions manually.
You are responsible for appropriate lot size, leverage, margin, stop-loss policy, maximum drawdown limits, VPS reliability, internet access, terminal settings, and account permissions. Default values are not personalized recommendations.
6. License, account binding, and delivery
Subject to payment and these Terms, BOTIFY grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to use the purchased compiled release on the registered account and broker-server identity specified at checkout. A Demo license is strictly limited to a MetaTrader account whose runtime trade mode is Demo and cannot provide protected functionality on a Real/Live or Contest account. A Live license is limited to the registered Real/Live account. The MetaTrader runtime and BOTIFY licensing service independently verify product, license scope, login, broker server, trade mode, version, status, and expiry.
The license does not transfer ownership of the Software or source code. Time-limited access expires unless renewed; a perpetual license applies only to the purchased major version and does not guarantee future products or services. The permitted account count is the limit recorded with the license.
Broker name, account ID, and account type entered at checkout are customer-provided claims, not proof of the actual account environment. You must provide the exact account ID, broker server, platform, and account type. BOTIFY never needs or requests your broker trading password.
7. Intellectual property and prohibited conduct
The Software, design, compiled code, source code, product names, documentation, licensing methods, and website content remain the exclusive property of BOTIFY or its licensors. You must not reverse engineer, decompile, disassemble, decode, bypass licensing, remove notices, resell, rent, share, publish, distribute, mirror, sublicense, expose, or create derivative commercial products from the Software except where a non-waivable law expressly permits a narrow act.
You must not use the website or support channel to transmit malware, attempt unauthorized access, probe private endpoints, submit fraudulent payment events, abuse another customer’s account, or interfere with service availability.
8. Technical and third-party dependencies
The Software depends on systems BOTIFY does not control, including MetaTrader, operating systems, brokers, liquidity providers, VPS hosts, market data, payment processors, blockchain networks, wallets, chatbot providers, internet providers, antivirus products, and device configuration. Updates or failures in those systems may cause incompatibility, interruption, delayed execution, missing data, changed results, or permanent loss of access.
BOTIFY does not warrant continuous availability, error-free operation, compatibility with every broker or symbol, uninterrupted payment or third-party chat processing, or recovery of files lost from your device. You must keep secure backups of delivered files and documentation.
9. Payments, card-to-crypto transactions, account balance, and refunds
Prices and available payment methods are displayed at checkout. The official amount is calculated by BOTIFY from the selected product and license type; a browser-supplied amount is never authoritative. Cryptocurrency payments are processed by an independent provider and blockchain transactions may be irreversible. You are responsible for choosing the correct asset and network, sending the exact required amount, paying network fees, and protecting your wallet credentials. BOTIFY will never request a seed phrase or private key.
When a card or another fiat method is available, you leave BOTIFY and pay an independent fiat-to-crypto provider. That provider—not BOTIFY—determines country and customer eligibility, available card or local payment methods, identity-verification requirements, limits, exchange or conversion terms, and fees. The provider may request a phone number, photo ID, and selfie. BOTIFY does not collect or store your card number, CVV, or the identity documents submitted to that provider. A browser return does not prove payment; BOTIFY credits an account balance or activates access only after a valid signed finished-settlement notification.
Account-balance credits and debits are recorded in BOTIFY’s server-side ledger. Amounts displayed or submitted by the browser cannot create credit or change the official purchase price. A payment-provider refund, card reversal, or chargeback may be delayed, unavailable, or subject to the provider’s and card network’s rules, conversion effects, fees, and mandatory consumer law. Where a settled payment is later refunded or reversed, BOTIFY may reverse related balance credit and suspend associated licenses or VIP access while preserving the required payment and security audit record.
Demo licenses can be activated only on MetaTrader Demo accounts. Except where mandatory consumer law requires otherwise, a Demo order submitted with Live/Real account details is not eligible for a refund, replacement license, reassignment, or alternative Live activation. Digital files personalized and compiled for a unique account cannot ordinarily be returned or reassigned after generation or delivery. Duplicate, partial, late, wrong-asset, or wrong-network payments are handled subject to provider capabilities, network finality, actual funds received, and reasonable processing costs.
10. Support limitations
Customer support assists with installation, licensing, access, payment status, documented product settings, and reproducible technical defects. Public website chat may use Spaceship’s Thunderbolt AI service and human handoff; its responses are general assistance, may be incomplete, and are not authoritative changes to an order, balance, license, policy, or these Terms. Use authenticated BOTIFY support for private account matters. Response times are estimates, not service-level guarantees.
Support does not include account management, signal provision, trade monitoring, recovery of trading losses, broker disputes, tax advice, legal advice, or strategy customization unless separately agreed in writing. Never submit passwords, one-time codes, card details, seed phrases, private keys, broker logins, or identity documents through any support channel.
11. Disclaimer of warranties
To the fullest extent permitted by applicable law, the website, Software, documentation, downloads, updates, and support are provided “as is” and “as available,” with all faults and without any express, implied, or statutory warranty. BOTIFY disclaims warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, accuracy, profitability, reliability, compatibility, availability, security, and error-free operation.
No oral or written statement creates a warranty unless it is expressly included in a signed written agreement issued by BOTIFY. Some jurisdictions do not permit exclusion of certain warranties, in which case the exclusion applies only to the maximum lawful extent.
12. Assumption of risk and limitation of liability
You knowingly and voluntarily assume all risk arising from market participation, leverage, automated execution, broker conduct, configuration, and reliance on the Software. To the fullest extent permitted by applicable law, BOTIFY and its owners, developers, contractors, licensors, and service providers will not be liable for trading losses; lost profits; loss of capital; margin calls; stop-outs; missed opportunities; loss or corruption of data; broker, wallet, network, tax, regulatory, or third-party charges; business interruption; reputational harm; or any indirect, incidental, special, exemplary, punitive, or consequential damages, whether arising in contract, tort, negligence, strict liability, statute, or otherwise.
Where liability cannot lawfully be excluded, BOTIFY’s aggregate liability arising from a product or these Terms will not exceed the amount you actually paid BOTIFY for the affected product during the twelve months immediately preceding the event giving rise to the claim. This limitation is an allocation of risk reflected in the Software price and applies even if a remedy fails of its essential purpose or BOTIFY was advised that damage was possible. Nothing excludes liability that applicable law makes non-excludable.
13. Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless BOTIFY and its owners, developers, contractors, licensors, and service providers from third-party claims, losses, penalties, liabilities, and reasonable costs arising from your trading activity, breach of these Terms, misuse or redistribution of the Software, violation of law, infringement of another person’s rights, fraudulent payment activity, or use of an account you were not authorized to control.
14. Suspension, termination, and updates
BOTIFY may suspend access, withhold delivery, or terminate a license where payment is reversed or fraudulent, account information is false, licensing is bypassed, the Software is redistributed, the website is attacked, or these Terms are materially breached. Terms may be updated prospectively to reflect products, law, payment services, or risk controls. The version accepted at checkout is recorded with the order. Continued use after notice of a lawful update constitutes acceptance from its effective date.
15. Disputes, severability, and entire agreement
Before filing a formal claim, you agree to send a detailed written notice through BOTIFY support and allow thirty days for good-faith informal resolution. These Terms are governed by the law applicable to the BOTIFY contracting entity and customer transaction, without overriding mandatory consumer protections that cannot lawfully be waived. The competent courts determined by applicable law retain jurisdiction unless the parties agree to another lawful dispute process in writing.
If a provision is held invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain effective. Delay in enforcing a right is not a waiver. These Terms, the order record, the product description, and any signed written agreement form the entire agreement concerning the Software and replace prior inconsistent statements.
